IMPORTANT — PLEASE READ CAREFULLY BEFORE USING THE SERVICE.

This End User Licence Agreement ("EULA" or "Agreement") is a legally binding contract between you ("User", "you", "your") and CogWorks, a sole proprietorship trading as Cog Camo VPN ("CogWorks", "we", "us", "our"), governing your use of the Cog Camo VPN software applications and related services (collectively, the "Service").

By creating an account, installing, or using the Service, you agree to be bound by the terms of this EULA. If you do not agree, you must not use the Service.

1. Definitions

• "Application" means the CogCamo VPN client software for Windows and/or Android, including all updates, patches, and accompanying documentation.
• "Service" means the VPN service provided by CogWorks, including the Application, backend authentication infrastructure, and VPN server network.
• "Account" means your registered user account with the Service.
• "Beta Period" means the initial testing phase during which access to the Service may be limited, free or discounted, and subject to additional terms communicated at the time of registration.

2. Licence Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

1. Download, install, and use the Application on devices you own or control, solely for your personal, non-commercial use.
2. Access the VPN servers operated by CogWorks through the Application for the purpose of securing your internet traffic.

This licence does not convey any ownership interest in the Application or Service.

3. Account Registration & Security

• You must provide a valid email address and create a secure password (minimum 8 characters) to register.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your Account.
• You must notify us immediately at contact@notacog.studio if you suspect unauthorised access to your Account.
• Accounts are personal and may not be shared, sold, or transferred to any other person.

4. Acceptable Use

You agree that you will not use the Service to:

• Engage in any activity that is unlawful under the laws of England and Wales, or the jurisdiction in which you reside.
• Transmit, distribute, or store material that infringes any third party's intellectual property rights.
• Distribute malware, viruses, or other harmful code.
• Conduct denial-of-service attacks, port scanning, or network intrusion against any system.
• Send unsolicited bulk communications (spam).
• Access, distribute, or produce child sexual abuse material.
• Harass, threaten, defame, or intimidate any person.
• Circumvent or interfere with the security or integrity of the Service or any connected network.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the Application, except to the extent permitted by applicable law.
• Resell, sublicence, or provide access to the Service to third parties.
• Use the Service for any activity that could harm CogWorks' reputation or expose CogWorks to legal liability.

5. Beta Programme

During the Beta Period:

• The Service is provided on an "as-is" and "as-available" basis for evaluation purposes.
• We may impose a user cap, modify features, or terminate the beta programme at any time.
• Trial accounts automatically expire after the period specified at registration (currently 7 days unless otherwise stated).
• We are under no obligation to continue providing the Service beyond the Beta Period.

6. Intellectual Property

All intellectual property rights in and to the Application, Service, and all related materials (including but not limited to source code, object code, design, logos, and documentation) are and shall remain the exclusive property of CogWorks or its licensors.

Nothing in this EULA grants you any right, title, or interest in any intellectual property owned by CogWorks, except for the limited licence expressly set out in Section 2.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://privacypolicy.notacog.studio. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

8. Disclaimers & Limitation of Liability

8.1 No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, error-free, or free of viruses or other harmful components; (b) the Service will meet your specific requirements; or (c) any defects will be corrected.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• IN NO EVENT SHALL COGWORKS, ITS OPERATORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
• COGWORKS' TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
• NOTHING IN THIS EULA EXCLUDES OR LIMITS LIABILITY FOR: (a) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (b) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (c) ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

8.3 VPN Limitations

We do not guarantee complete anonymity. The Service is designed to enhance your privacy and security, but no VPN can provide absolute protection against all forms of surveillance or data interception. You acknowledge that security and privacy online are affected by factors beyond our control.

9. Suspension & Termination

• We may suspend or terminate your access to the Service immediately if you breach any provision of this EULA.
• We may terminate the Service or your Account at any time for any reason with reasonable notice.
• You may terminate your Account at any time by using the "Delete Account" feature within the Application or by contacting us at contact@notacog.studio.
• Upon termination, your licence to use the Application ceases immediately. Sections 6, 8, 10, 11, and 12 survive termination.

10. Indemnification

You agree to indemnify and hold harmless CogWorks, its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of this EULA; or (c) your violation of any law or the rights of any third party.

11. Governing Law & Dispute Resolution

This EULA is governed by and construed in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that we may seek injunctive or other equitable relief in any court of competent jurisdiction.

If you are a consumer resident in the EU, nothing in this section restricts any mandatory consumer protection rights that apply under the laws of your country of residence.

12. General Provisions

• Entire Agreement — This EULA, together with the Privacy Policy, constitutes the entire agreement between you and CogWorks regarding the Service.
• Severability — If any provision of this EULA is found to be unenforceable, the remaining provisions shall continue in full force and effect.
• Waiver — Failure to enforce any provision of this EULA shall not constitute a waiver of that provision.
• Assignment — You may not assign your rights or obligations under this EULA. CogWorks may assign its rights and obligations without restriction.
• Amendments — We reserve the right to modify this EULA at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after such notification constitutes acceptance of the revised terms.
